“My son is a Marine.
On Friday he was lined up with his unit and others who were not vaccinated,” wrote Amanda on her son’s behalf.
He declined the shot and provided his religious exemption form.
Service members cannot be forced to take a drug that has not been fully approved by the FDA, unless there are several declarations stating sufficient reasons to do so.
There are no such legal declarations.
Right now, the only FDA approved COVID shot is BioNTech’s Comirnaty - but it is not yet available.
The only COVID drugs available to the military or members of the public are those COVID shots licensed for Emergency Use Authorization only. This means, you have the “option to accept or refuse” the shots.
All service members have the right to refuse these drugs regardless of medical or religious exemptions.
In addition to military law, all armed forces members are covered by the First Amendment and the federal Religious Freedom Restoration Act (a powerful law which the Supreme Court called a “super statute”).
Under these provisions, military members have the right to refuse a vaccine without punishment if that drug violates their deeply held religious convictions.
The DOD has no legal right to deny, refuse or ignore these religious exemption requests.
But that isn’t stopping them from violating the law anyway.
Like so many service members who contacted us, Amanda’s son has become a victim of a lawless administration.
When Amanda’s son submitted his religious exemption form, he was handed formal charges under the Uniform Code of Military Justice (UCMJ).
He will be dishonorably discharged in November “for his refusal to take the COVID vaccine.”
Amanda’s son will be fortunate if the Marine Corps does not hold him in “the brig” (military jail) until they kick him out of the service.
What is happening to Amanda’s son is happening to service members all across the nation.
Shockingly, many of the service members who have contacted our office for help report even worse threats being made by their chain of command – including up to two years in a military prison solitary confinement unit – for daring to claim their right to religious freedom.
A dishonorable discharge is worse than a felony conviction and prison.
Being dishonorably discharged is the ultimate betrayal that will follow them the rest of their lives.
These service members fought and bled for OUR freedom.
They should be honored, not discarded like trash.

BREAKING NEWS – Yesterday, the U.S. Supreme Court agreed to hear our case where the city of Boston censored Camp Constitution’s Christian viewpoint during a celebration of Constitution Day.
The briefs are due next month.
I will argue the case early next year, and a decision from the Court is expected by the end of June 2022.
This case will set national precedent.
