Is Donald Trump the savior of America or a dangerous loose cannon?

It may not matter, according to Conservative Review senior editor Daniel Horowitz, because the president does not have the final say over political and societal questions. That honor currently belongs to the unelected men and women in black robes.

“Every day a court tosses out another common sense law from a red state,” Horowitz said during a recent appearance on the radio program “Powers to the People.” “So just know if you want Trump to be president, whatever he does, to the extent that he follows through with it, will be tossed out by the courts.”

Last month a federal appeals court ruled that Utah’s state government must continue to fund the state branch of Planned Parenthood, even though Republican Gov. Gary Herbert had tried to cut off funding. In June, a federal district judge ordered the Gloucester County, Virginia, school system to stop blocking a female-to-male transgender student from using the boys’ restrooms in county schools.

Of course, this is not to mention the federal courts that have struck down state voter ID laws, most recently in North Carolina, Texas and Wisconsin.

Horowitz views what he calls the “judicial oligarchy” as the most dangerous institution in society. He said the courts are engaging in “social transformation without representation,” which is what motivated him to write his most recent book “Stolen Sovereignty: How to Stop Unelected Judges From Transforming America.”

“I realized, oh my gosh, we’re not going to have a democracy left,” Horowitz stated. “You know, a lot of people are talking about Trump. Depending on who you talk to, he’s either the last savior for Republicans or he’s the biggest disaster, but I disagree with both of them because it really doesn’t matter much.”

He explained, “The utility of electing even a conservative government on a state level, on a federal level, will be meaningless because anything we want to do will be overturned by the courts if we don’t stop them.”

The framers of the Constitution never intended the judicial system to be a “council of revision,” according to Horowitz. Rather, it was meant to be a co-equal branch of government. Even Chief Justice John Marshall and other early proponents of a strong judiciary only believed judicial review was appropriate when a law clearly went against the Constitution as originally written.

But if any law duly passed by a legislative body can be thrown into the court system and revised, then America isn’t a democracy anymore, in Horowitz’s view.

He noted our forefathers fought the American Revolution over “taxation without representation,” which is not as devastating as societal transformation without representation.

“At this point we don’t even have the opportunity to have the opportunity to change hearts and minds in the political realm, because the unelected branches of government decide every major social and political question through their social transformation without representation,” Horowitz lamented.

Many conservatives claim all we need to do is elect a conservative president who will appoint conservative judges to the federal courts, but Horowitz disagrees.

“That’s nonsense!” he exclaimed. “We’ve been doing that for 50 years, and there are many problems with that. It doesn’t work in the long run. We need wholesale judicial reform. We need to reclaim our state, federal and individual sovereignty.”

The way to reclaim sovereignty, according to Horowitz, is for Congress to strip the courts of jurisdiction over foundational social and political issues such as immigration, voter ID and marriage. As Horowitz explains in his book, Article III Section 2 of the Constitution gives Congress the power to do just that.

“We don’t have to sit back and take this garbage from the courts,” Horowitz said. “We don’t have to change the Constitution. This is our Constitution. They’re the ones who are revising it illegally.”

He admitted it will be hard for Americans to change the way they think about the courts.

“People like finality,” he acknowledged. “They like uniformity. So it makes sense: ‘Well, let’s take this to the eminent tribunal. What do they say?’ But if you think it through its logical conclusion, that means we don’t have elections in this country. We don’t have a democracy, because the unelected branch can ultimately do whatever they want.”

If the American people wish to preserve their form of government, Horowitz insists they must reclaim the sovereignty the courts stole from them.

“The time for sneering and rolling your eyes at the courts is over with,” Horowitz declared. “It’s time for action. It’s time to say this is illegitimate and if we allow this to go on another half a generation, we will not have a democracy left. 

The courts need to be stripped down to size.”
