COURT REVIVES STATE'S ABORTION WAITING-PERIOD LAW
Appeals judges say sufficient evidence exists to make a case for constitutionality
A surge in pro-life court decisions that has developed since President Trump began appointing conservative judges continued Thursday.
A Florida appeals court reversed a decision to block a 2015 law requiring a 24-hour wait for an abortion.
Leon County Circuit Court Judge Terry Lewis ruled in January 2018 that the law is unconstitutional. But the 2-1 decision from the state’s First District Court of Appeal in Tallahassee overturned the ruling.
The appellate panel concluded the state provided sufficient evidence of the constitutionality of the law, and the case was returned to the lower court for a full trial.
“I am pleased that the court breathed new life into this important law,” said Mat Staver, chairman of Liberty Counsel, which joined in arguments in the case.
“The court of appeals cited our brief. The 24-hour waiting period is critical because abortion is a life and death decision.
Abortion advocates oppose a waiting period because they fear the mother will choose life.
How sad that a mother can kill her pre-born child without waiting even 24 hours, and yet, when someone other than the mother kills the same child, it is a criminal offense,” said Staver.
