OBAMA 'ON STRIKE AGAINST WILL OF AMERICAN PEOPLE'
Administration refuses to deport thousands of visa overstays
Leo Hohmann
The government provided its long awaited study on visa overstays this week, and it showed half-a-million foreign travelers who violated the terms of their visas last year were never deported by the Obama administration.
Worse yet, their the whereabouts of most are not even known.
The 28-page report by the Department of Homeland Security identified just over 527,000 foreign visitors who did not leave the country as required when their visas expired last year. Approximately 484,000 were presumed to be still in the United States at the end of 2015, and 416,500 had not departed as of two weeks ago on Jan. 4.
Those numbers include hundreds of visitors from countries with large terrorist populations such as Syria, Iraq, Pakistan and Iran.
And the numbers are actually much higher because the study only looked at a very limited subset of visitors – those entering the U.S. by air or sea for business or pleasure. It did not examine student visas or any of the many temporary work visas.
“This subset of 45 million admissions is only a fraction of the total non-immigrant admissions to the United States in 2015 by air, sea, and land for all purposes,” wrote research analyst Jessica Vaughan for the Center for Immigration Studies.
The study infuriated but did not surprise immigration hawks in Congress.
Sen. Jeff Sessions, R-Ala., the chairman of the Senate subcommittee on immigration and the national interest, lashed out at the administration Wednesday for what he believes to be dereliction of duty.
He said DHS has refused to implement an automated entry-exit tracking system at all air, land and seaports as required by Congress. This is the only way to know which aliens have left and which have remained in violation of their visas, Sessions said.
Congress has passed “half-a-dozen laws” over the past decade requiring this system be implemented, he said. But, like many laws passed by Congress, they were “more show than substance,” Sessions said at a congressional hearing Wednesday on the problem with visa overstays.
Watch video clip of today’s Senate hearing:
"If we do not track and enforce departures, then we have open borders, especially the way it's being carried out today. It's as simple as that," he said.
'Everyone can come in. No one has to leave'
He said upward of 40 percent of the more than 12 million illegal migrants living in the U.S. today did not cross the border illegally; rather, they overstayed their visa.
"Such policies being carried out today is a demonstration by our government that the exit-date requirement has no meaning," Sessions said. "Again, this is the very essence of open borders. Everyone can come in. No one has to leave."
If 40 percent of the illegal aliens now in the country are a result of visa overstays, that would include 4 to 6 million people, noted Sen. David Perdue, R-Ga.
Yet, a DHS official who testified at the hearing told Perdue that only 3,000 overstays were identified and investigated last year.
The policies of the Obama administration are that the government does not deport people unless they've been caught committing a felony offense, Sessions said. "No action will be taken."
"In addition to the harm done to American job-seekers and taxpayers, this also poses a substantial national-security risk and a monumental erosion of the integrity of the law that encourages more violations."
Alien population larger than any city in N.H., S.C. or Iowa
Sessions said the entry-exit tracking system was one of the key provisions recommended by the 9/11 Commission. But it was never carried out by the Department of Homeland Security.
"The situation is dire," he said. "The time to act is now."
The nearly 500,000 still in the country after their visas expired last year does not include students or guest workers.
"That is a population of individuals that is larger than any city in Iowa, New Hampshire or South Carolina," Sessions said.
The report details "extremely troubling information" about countries that harbor terrorists, he said.
Among those who overstayed their visas last year and remain in the country are 219 visitors from Afghanistan, 681 from Iraq, 564 from Iran, 56 from Libya, 1,435 from Pakistan, 440 from Syria and 219 from Yemen. This was just for one year.
"This program, despite clear law, makes no attempt to find these people," to deport them or fine them, Sessions said.
'Our executive branch is on strike'
"Our executive branch is on strike against the will of the American people and the requirements of Congress," he continued. "Under Secretary Jeh Johnson's policies, and the president's policies, aliens who overstay their visas but manage to avoid being convicted of any crimes have practically no chance of ever being removed from the United States. American citizens face criminal charges if they lie to authorities, illegally take someone's money, or steal someone's identity, yet we allow millions of aliens to come on temporary visas, ignore our laws, violate their pledge to leave by a certain date, and take jobs and benefits directly from Americans. Simply put, there is no border at all if we don't enforce our visa rules.
"Even violent and dangerous aliens are allowed to roam freely in the country until they've robbed or killed an innocent American. We need to remove alien overstays before they hurt innocent Americans, before they engage in terrorism, not wait until it's too late. Every time you hear about the deportation of a convicted criminal killer, remember this. If we had deported that alien before the crime, that American would still be alive. The lawlessness cannot continue. We must establish a tracking system at every land, air and sea port, and we must send a message to the world: If you overstay your visa, you're going to be sent home."

They are doing everything in their power to allow as much Immigration as possible.
