One of our cases is making national news again. Even presidential candidate Kamala Harris has changed her speeches to denigrate our work, promoting perversion and attempting to end religious freedom.
The case at hand is that of Kim Davis, the quiet County Clerk who spent six days in jail for refusing to relinquish her religious freedom and disobey God. Kim fought for, and won, religious accommodation rights for all Kentucky officials. But the same judge who sent Kim to jail has now issued a judgment against her, awarding two men who relentlessly harassed Kim 360,000 dollars.
Does anyone really have religious freedom if you can be personally sued into bankruptcy for using that right?
The media and the opposition are concerned about our case. The reason the Kim Davis case garnered so much attention around the country the past couple of days is because of what it could mean for the future of America. I will share some of their concerns below.

We have filed our legal brief on Kim’s case with the Sixth Circuit Court of Appeals. We made it clear from the beginning that our intent is to not only free Kim from this unjust burden but also to overturn the U.S. Supreme Court’s wrongfully decided opinion in Obergefell v. Hodges once and for all. Kim was the first victim of this incantational 2014 opinion by “five lawyers” (which Chief Justice John Roberts called them). Now, this godly woman has the chance to overturn this bad decision.
With little else to run on, the LGBTQ-driven media and presidential candidate Kamala Harris has put our case in headlines across the country and the issue in our case has become a major factor in Harris’ latest speeches.
As if it weren’t clear enough exactly what we are battling, the “news” website Jezebel.com broke the story. Within 24 hours, scores of national news sites (including the AP) had picked up the story. Within 48 hours, Harris was using the story to drum up support from the handfuls of potential voters who showed up at her rallies.
The uproar since then has been staggering. Once again, our offices are being flooded with hateful threats. And my wife, Anita, president of Liberty Counsel Ministries, has received a direct threat.
But we will not falter!
Don’t let the Jezebel spirit erase religious freedom! Support our legal fund today.
Even Jezebel.com admits that Kim’s case will likely overturn the wrongfully decided Obergefell decision that invented the right to same-sex marriage.
The rabid LGBTQ left is terrified that we will tear down their demonic strongholds. As well they should be, for our God is greater!
Our case rightly argues that the religious accommodation rights Kim won for all Kentucky officials means nothing if parties can personally sue someone into bankruptcy for choosing to use their religious freedom rights.
More importantly, our case argues that Obergefell was wrongly decided and that there is no constitutional “right” to same-sex marriage.
Our argument is straightforward: Obergefell should be overturned for the same reasons articulated by the Court in the Dobbs decision that overturned abortion. As with Roe v. Wade, the activist High Court at the time was wrong when Roe was decided and it is wrong today because it was based entirely on the “legal fiction” of “substantive” due process, which lacks any basis in the Constitution.
Early comments from U.S. Supreme Court Justices indicate we may have an excellent chance of overturning that awful 2015 ruling, just like we helped overturn Roe v. Wade.
In a 2020 response to a Liberty Counsel filing, Supreme Court Justices Clarence Thomas and Samuel Alito wrote, “This petition implicates important questions about the scope of our decision in Obergefell.”
“Since Obergefell,” Justice Thomas continued, “parties have continually attempted to label people of good will as bigots merely for refusing to alter their religious beliefs in the wake of prevailing orthodoxy.”
Furthermore, in Justice Thomas’ concurring opinion on Roe, he noted that the “substantive” due process issues the Court rejected in that case may also apply to Obergefell. Justices Thomas, Alito, and Roberts dissented in the Obergefell case. Now that we have a largely conservative Court with a majority of Justices who are contextualists, i.e., who apply the law according to the Constitution as written, not how they wish it was, I believe we have an excellent chance of winning this case. God willing, we will free Kim Davis from the unjust judgment leveled against her, we will restore true religious liberty for all, and we will overturn Obergefell.
Please, give generously today and a special Challenge Grant will DOUBLE the impact of your gift.
Finally, the ancient spirit of Jezebel is alive and well. All of us here at Liberty Counsel covet your prayers of protection and heavenly guidance as we continue to fight for God-honoring people everywhere. |
