On Aug. 23, 2021, Biden’s FDA issued a letter that expressly states there are NO FDA-approved COVID shots available:
“Although COMIRNATY (COVID-19 Vaccine, mRNA) is approved to prevent COVID-19 in individuals 16 years of age and older, there is not sufficient approved vaccine for distribution” (FDA letter to Pfizer, page 6, footnote 12, emphasis added).
According to the FDA, Pfizer and BioNTech’s Comirnaty are LEGALLY DISTINCT.
Pfizer remains under Emergency Use Authorization while Comirnaty is FDA approved.
BUT Comirnaty is unavailable because “there is not sufficient approved vaccine for distribution to this population.”
EVERY COVID SHOT IS UNDER EUA, MEANING YOU HAVE THE “OPTION TO ACCEPT OR REFUSE” THE PRODUCT!
But Biden thinks he can deceive people into believing he can force them to take the shots.
This is a lie, and we will address this in our class action lawsuit.
Lawlessness abounds in this administration, but Liberty Counsel is about to defeat the lies with TRUTH ... in court.
Veronica writes from a military installation in Florida.
She says the base command “is lying to members and saying they offer the FDA-approved vaccine when they are only injecting service members with non-approved emergency use vaccines. Members’ rights were violated.”
Tamara writes from a military base in Washington state: “Military is ignoring federal law! Service members being told that federal law does not matter in regard to EUA vaccines.”
When military attorneys at Tamara’s base were presented with the EUA, “they did not care about the legality of EUA vs. FDA approval,” and that “the Navy has made a decision that supersedes federal law.”
No can do!
Justin writes from a military base in Kentucky, where he has been informed that neither his religious exemption nor his medical exemption for traumatic brain injury will be honored:
“I have 9 days to receive the shot, or I will be facing a dishonorable discharge,” Justin wrote on his legal help intake form.
“I was given an order to receive any of the shots regardless of FDA approval, [and] that they will not approve any religious exemptions no matter what.”
Justin goes on to note, “A dishonorable discharge would make me completely unemployable in the civilian world.”
Justin isn’t alone in receiving threats from his commanders. Service members are being threatened with dishonorable discharge, and a stint in military prison—including solitary confinement—if they request an exemption from the shots.

The First Amendment and the Religious Freedom Restoration Act (RFRA) protect all federal employees, including military members and civilian contractors, from being forced to violate their deeply held religious convictions.
Last year, the U.S. Supreme Court described RFRA as a “super statute,” which supersedes the unlawful edicts and actions of Biden and the DOD.
Indeed, it is a powerful law that protects religious freedom.
Make no mistake, Biden’s shot mandate is unlawful—and Liberty Counsel is going to court to fight this lawlessness.
This week, Liberty Counsel is filing a class action lawsuit against Joe Biden and his Department of Defense on behalf of active-duty and reserve military members, federal employees and civilian contractors.
