DiGenova: Sessions, Rosenstein Are 'Two Worst Officials’ In DOJ History

Commenting on the pending wrap-up of Special Counsel Mueller's investigation of alleged Russia-Trump collusion, prominent D.C. attorney and former federal prosecutor Joe diGenova said "there are no Russia collusion indictments" and that DOJ officials Jeff Sessions and Rod Rosenstein "will go down in history as the two worst officials in the Department of Justice."
DiGenova, who led the prosecution of Israeli spy Jonathan Pollard, also said that House Judiciary Chairman Bob Goodlatte (R-Va.) is an "embarrassment" and "cowardly" because of his kowtowing to Deputy Attorney General Rod Rosenstein who, diGenova added, "has committed perjury on a number of occassions."
During an Oct. 22 interview on WMAL's Mornings on the Mall, diGenova was asked about the Muller investigation.
DiGenova said, “Well, we already know there are no Russia collusion indictments, which is the single most important fact about his investigation."
"We know that [Deputy Attorney General] Rod Rosenstein authorized the [special counsel] investigation without any legal authority to do so and without any crime ever having been committed," said diGenova.
"Rosenstein did that to protect himself from being involved in complex political decisions about investigations."
He continued, “We know that [Special Counsel Robert] Mueller does not have the authority to issue a report because he was set up under – he was appointed, rather, under department regulations that do not, cannot authorize a report.
And the reason he can’t issue a report is because much of what he has done happened before a grand jury and that’s all secret and can never be revealed."
"The only person he could send any information to would be to Rod Rosenstein, who is under no authority to give it to Congress and Congress could not force him to do so because it’s grand jury," said diGenova.

Despite those restrictions on information-sharing, diGenova said, “I expect Mueller’s people to leak information illegally.
I expect nothing to happen to them as a result of it because the current occupants of the Department of Justice are completely disinterested in enforcing the law against their own people."
"I think [Attorney General] Jeff Sessions and [Deputy Attorney General] Rod Rosenstein represent the worst period in the history of the Department of Justice, worse than the Palmer Raids," he said.
"I would say Sessions and Rosenstein will go down in history as the two worst officials in the Department of Justice in its history," said the former federal prosecutor and former counsel to the Senate Judiciary Committee.
WMAL hosts Mary Walter and Vince Coglianese then asked diGenova about the House Judiciary Committee's investigation of corruption at the FBI and DOJ, a scandal that has, so far, led to the firing of FBI Director James Comey, Deputy FBI Director Andrew McCabe, and FBI counterintelligence expert Peter Strzok.

"Have you watched [House Judiciary Committee Chairman Bob] Goodlatte?" said diGenova. "He’s like a guy in a sleepwalk when he asks questions in a hearing.
You know what? [Rod] Rosenstein demanded that [GOP Congressmen Mark] Meadows and [Jim] Jordan and others not be in the hearing because he knew he couldn’t withstand their questioning."
“Rosenstein has committed perjury on a number of occasions, and he’s trying to figure out a way not to commit perjury again," said diGenova.
"So what he’s done is he has demanded, as part of his testimony, that Jordan and Meadows and others like them not be present.
What an embarrassment."
"Goodlatte is a disgrace to the Republican Party and that House of Representatives," said diGenova.
"He is a cowardly chairman."
