RELIGIOUS FREEDOM CASE BEFORE SUPREME COURT COULD IMPACT OBAMACARE
As a refresher, the case of Masterpiece Cakeshop, Ltd v. Colorado Civil Rights Commission is in the hands of the United States Supreme Court. Jack Phillips, owner of Masterpiece Cakeshop is a devout Christian and artist who is known for his brushed artistry on cakes, including wedding cakes.
A gay couple asked Phillips to do their wedding cake, but he politely explained to them that he was a Christian and would be happy to sell them anything they wanted, but his faith would not allow him to be a participant in their same-sex wedding ceremony. Phillips also recommended other bakeries in the area that would be happy to take their order.
Naturally, the couple claimed to be offended and ran whining to the Colorado Civil Rights Commission, claiming they had been discriminated against due to their sexual orientation and the commission agreed and charged Phillips with a discrimination lawsuit. Phillips claimed that he has the First Amendment right of freedom of religion and that to be forced to make a wedding cake for a same-sex ceremony would be a violation of his religious freedom.
However, the Colorado Civil Rights Commission disagreed with Phillips and found him guilty. He has appealed his case to every court up the legal chain, but so far, every court has ruled against him. His case now rests in the hands of the 9 men and women on the nation’s highest court of the land.
The outcome of this case will have far reaching implications for many Christian business owners, who have been targeted by LGBT activists.
In some cases, the Christian run businesses have advertised in the Christian Yellow Pages and LGBT activists have used this to locate and target the Christian businesses for several reasons.
One, they get publicity for their perverted cause.
Two, they hope to get a large financial settlement,
and three, they hope to force Christians to either compromise their faith or close their business.
Some have defined this practice as a form of extortion, but as yet, no one has ever charged and LGBT activist with the crime.
Did you know that the outcome of the Supreme Court decision in Phillips’ case can also have an important impact on Obamacare, which congressional Republicans have failed to repeal or replace as promised?
The Trump administration took action to repeal the contraceptive mandate part of Obamacare, which requires all business owners to provide free contraceptive healthcare to all of their employees.
This free contraception benefit includes abortion-causing drugs such as the ‘morning after’ pill.
Additionally, many forms of birth control are also a form of abortion as they prevent a fertilized egg from being implanted into the wall of the uterus, resulting in it’s expulsion from the body.
Since many Christians believe that life begins at conception, then these forms of birth control are just a different form of abortion, which is against biblical teaching.
However, one liberal judge took it upon herself to block the Trump administration’s repeal of the contraceptive mandate. The result of that judge’s ruling, is that the harm done to one group – women who could not otherwise afford birth control – was worse than violating the First Amendment right of Christian business owners.
Some believe that the Trump administration will appeal that judge’s ruling, but even if they don’t, the Supreme Court’s ruling of Phillips’ case could automatically override the contraception mandate aspect of Obamacare.
If the high court rules that Phillips has the First Amendment right of freedom of religion and that to force him to make a cake for a gay couple would be a violation of that constitutional right,
then the same argument could be made for any Christian business owner as well as any Christian school, college and university concerning the contraception mandate, which is what the Trump administration was trying to do all along.
Hopefully, the Trump administration will appeal the court ruling to block the repeal of the contraception mandate and force the issue to the Supreme Court, but again, their ruling on such an appeal hinges on their ruling in Phillips’ case.
