OBAMACARE ABORTION-PILL MANDATE 'UNCONSTITUTIONAL'

Judge says it's not just religious groups who are exempt

A federal judge on Monday undermined the Obama administration’s position that only “religious organizations” can be exempted from Obamacare’s requirement that insurance policies provide contraceptives, including abortion-causing drugs.

In a case brought by the nonprofit March for Life, U.S. District Judge Richard Leon ruled that those who oppose abortion on the basis of faith or moral beliefs should be exempt.

After an uproar, Washington backed down from the contraceptive mandate, exempting religious organizations. But it has fought case after case to impose that requirement on everyone else.

The administration has lost several times, including the U.S. Supreme Court Hobby Lobby case.

In the newest ruling, Leon found the mandate “violates the equal protection clause of the Fifth Amendment and must be struck down as unconstitutional.”

Matt Bowman, a senior legal counsel for the Alliance Defending Freedom, which represented March for Life, said the ruling opens the possibility that a range of additional individuals and organizations qualify for an exemption.

The judge noted the way the Obama administration handled the exemption for religious organizations.

“What HHS claims to be protecting is religious beliefs, when it actually is protecting a moral philosophy about the sanctity of life,” he wrote. “HHS may be correct that this objection [to abortion] is common among religiously affiliated employers. Where HHS has erred, however, is in assuming that this trait is unique to such organizations.

“It is not,” he wrote.

For example, “anti-abortion advocacy is March for Life’s sole and central tenet. ”

“It is an entity founded exclusively on pro-life principles, and its governing ethos – indeed its corporate dogma – is staunchly anti-abortifacient,” Bowman said.

“To say that its employees oppose contraceptives understates the vehemence of their objection,” he said. “According to plaintiffs, March for Life’s employees not only reject abortifacients in principle, but they ‘don’t want them, don’t want coverage for them, and will not use’ them in practice.”

He argued that March for Life and exempted religious organizations “are not just ‘similarly situated,’ they are identically situated.”

“Their employees share, as a function of their belief system, the ‘unique’ tenets of an employment relationship that HHS seeks to protect. It is difficult to imagine a more textbook example of the trait HHS purports to accommodate.”

The judge said that not exempting March for Life because it is “not religious” is “nothing short of regulatory favoritism.”

The judge said that if the purpose of the religious employer exemption is, as HHS states, “to respect the anti-abortifacient tenets of an employment relationship, then it makes no rational sense – indeed, no sense whatsoever – to deny March [for] Life that same respect.”

“The order is the first one to be granted in favor of an organization opposed to the mandate for pro-life reasons based on moral convictions instead of religion,” ADF said in its report on the ruling.

March for Life, which holds its well-known, pro-life march each year in Washington, asked for the injunction in July 2014.

Forced to ‘betray values’

The Obamacare mandate was written to force employers, regardless of their moral convictions, to provide insurance coverage for abortion-inducing drugs, sterilization and contraception under threat of heavy financial penalties through the IRS.

“Pro-life organizations should not be forced into betraying the very values they were established to advance,” said Bowman.

“This is especially true of March for Life, which was founded to uphold life, not to assist in taking it. The government has no right to demand that organizations provide health insurance plan options that explicitly contradict their mission.”

March for Life was organized after the 1973 Supreme Court ruling that legalized abortion nationwide. Its very existence is based on its opposition to abortion, and its moral beliefs “forbid it from furthering abortion through health insurance coverage it offers to its employees,” ADF argued.

March for Life’s beliefs “are based solely on non-religious ethics and science,” ADF said, even though some employees also claimed faith-based reasons.

“Americans should not be forced to choose between following their deepest convictions and submitting to unlawful and unnecessary government mandates,” added ADF Senior Counsel Kevin Theriot. “We hope other courts that consider similar cases will issue their own orders upholding the right of pro-life organizations to be free from this type of government coercion.”

ADF and other attorneys are litigating a number of other cases also focusing on the abortion-pill mandate.

Along with Hobby Lobby, Wheaton College of Illinois and others have won rulings.

The Republican establishment is reportedly about to launch a massive blitz of commercials after Labor Day to take down front-runner Donald Trump in his quest for the 2016 GOP presidential nomination.

“The hottest conversation that’s going on right now in the donor community among the anti-Trump donors, is how do you take down Donald Trump, and what’s the vehicle to do it,” CNN’s Maeve Reston told her network colleague John King on Sunday.

But party officials are said to be too timid to attack Trump directly.

“There are a lot of donors out there who see it as much too dangerous, obviously, for the candidates, or their allied super PACs, to go after Trump,” Reston said. “So they’re looking to more establishment PACs to potentially take him down in post-Labor Day ads.”

Radio talk-show host Rush Limbaugh saw the report, and agrees with the premise “the Republican establishment is preparing to unleash on Trump after Labor Day.”

“Now they aren’t going to do it with their fingerprints on it,” Limbaugh explained. “They are looking for PACs that have no ties to current Republican candidates. They don’t want any fingerprints of the party directly on whatever this smear of Trump is going to be.”

If the anti-Trump assault does materialize, Limbaugh said GOP leaders are "running a huge, huge risk. It looks to me like the Republican Party is being as obstinate and stubborn as it's possible to be."

Limbaugh noted, "There's a lot to learn from this Trump campaign, this whole Republican primary has beaucoup (many) things to learn.

"If they're not gonna take even one of them and try to adapt even one thing much less a whole lot of things, then they're gonna be relegating themselves to minority status for I don't know how long. Irrelevancy."

 What is amazing is that this happened in Turkey’s capital Istanbul; how did this city become Muslim? It was conquered! By who? By Muslims! The Hagia Sophia, the holy church of Christendom and the Eastern Orthodox Church, was violently seized in 1453 by the Ottoman empire, whose soldiers stripped it of all its holy icons and its Crosses, and the sultan, Mehmet II, had an imam make the very same prayer to which Pope Francis prayed to. There is a very dangerous homosexual supporting ring deeply entrenched in the Vatican, which is helping enable it when it conducts mass with such a depraved heretic.

I have myself experienced, to some measure, this homosexual supporting ring in the Catholic Church, in a conversation I had with one priest and Catholic canon law judge, named Robert L. Kincl (also known as Fr. Bob Kincl), who was ordained in Rome. Kincl had befriended us as a fan of Shoebat.com acting as conservative, yet referred to homosexual fondling as permissible in the conversation. Having been shocked at his remarks, I told Kincl:

How can you, as a priest, be so liberal toward such a sick evil as two men fondling each other, or as two men having a “relationship” just as long as they are not going with other men. It is evil and it is reprobate.

I also told him:

It is not tolerable for you, as both a priest and a canon law judge, to be permissive to somebody having a homosexual relationship just as long as they are not being promiscuous with other men. It is deplorable, and in the words of St. Paul, “worthy of death” (Romans 1:32).

Kincl defended his position and responded with a rejection of the Old Testament and a twisting of St. Paul’s condemnation of homosexuality in Romans, stating

We do not follow the Hebrew Scriptures. We follow Jesus Christ who never mentioned gay relationships. When St. Paul mentioned such a relationship he was referring to the promiscuousness of the Romans using sodomy.

Shoebat.com decided to investigate Kincl and found that he has a dark past. In 1993, Kincl worked as a Commander in charge of clergy at the U.S. Navy, and while he was in the service he defended another chaplain confirmed to be guilty of child molestation, named Robert Hrdlicka.

Bobby Jindal: ‘Immigration Without Assimilation Is Invasion’

(CNSNews.com) - Louisiana Gov. Bobby Jindal told CBS’s “Face the Nation” on Sunday that people who want to come to the United States should learn English and adopt our values, because “immigration without assimilation is invasion.”

“One of the things I have been emphasizing, as the son of immigrants who came here legally, we need to insist on assimilation. In Europe, they're not doing that. They have got huge problems. Immigration without assimilation is invasion. That can weaken our country,” Jindal said. “We don't need to go down the path of Europe. Let's insist on being the melting pot. Let's forget this politically correct, left notion that we're not a melting pot anymore.”
Host John Dickerson asked Jindal, “Let me ask you a question about immigration, a topic that is much in conversation among Republicans. We know all Republicans candidates want to secure the border, but after that, there is the question of what to do with the undocumented workers who are in the United States.

“You said on CNN recently, you said, ‘I think American people will be pragmatic and compassionate about the people here.’ What does that mean about the 11 million, 12 million undocumented workers who are here now?” Jindal asked.
“I think the reason voters don't want a comprehensive approach, a gang of eight approach, is we tried that in the '80s. We were told, deal with it comprehensive, and we would get a secure border. That didn't happen. That's why I think it's right to sequence these things. Secure the border first, and then we can have the discussion about the folks that are here, but the bottom line is this,” Jindal said.

I have said hold the mayors and councilman, hold them criminally liable for the crimes committed by people that shouldn't be here illegally in the first place. After we have done that -- and it would only take six months to secure the border,”  said Jindal.

“I know left says we can't get it done. That's ridiculous. If we're serious about this, it won't be perfect, but we can get this done in six months. Then we can have the conversation about folks that are here illegally,” he added.

Sheriff Clarke: Obama ‘Started This War on Police’

(CNSNews.com) – In response to the execution-style murder of  Harris County Deputy Sheriff Darren Goforth, who was shot multiple times at a gas station in Cypress, Texas, Milwaukee County Sheriff David A. Clarke Jr. strongly criticized what he called the “black lies matter” movement and stressed that President Barack Obama himself had “started this war on police.”

On Fox’s “Justice With Judge Jeanine” on Aug. 29, the host asked Sheriff Clarke,  “Is it open season on law enforcement in this country?”

Sheriff Clarke said,  “Judge, I am too pissed off tonight to be diplomatic about what’s going on and I’m not going to stick my head in the sand about it.”

“I said last December that war had been declared on the American police officer led by some high profile people, one of them coming out of the White House, and one coming out of the United States Department of Justice,” said Clarke.

“And it’s open season right now,” he said.  “There’s no doubt about it. Anytime a law enforcement officer is killed, a little bit of every police officer in America dies along with them.”

Later in the interview, Judge Jeanine asked, “Finally, sheriff, the national rhetoric that’s going on. You say that people need to push back and we need, when we see things on Facebook and social media. You know, the truth is, people can say and do what they want. This is America. But, without leadership, there isn’t going to be any different reaction. More people seem to be emboldened by this kind of thing.”

Sheriff Clarke said,  “Right, and that’s why I said that the president of the United States started this war on police.”

“Look, and I know what you mean, judge, by that, but it’s not absolute,” said the sheriff.  “You can’t say anything you want in the United States of America: you cannot threaten people’s lives, you can’t call for the killing of people like we’re seeing from some of these things.”

“That is not First Amendment protected,” said Clarke.  “That is filth, that is slime, and there are some law enforcement implications that can be dealt with at the Department of Justice and with state attorney’s offices across the United States.”

“I love the First Amendment,” he continued.  “I love freedom of speech. You are not free to threaten my life or anybody else’s.”

Deputy Darren Goforth was killed on Friday, Aug. 28, while he was pumping gas into his car at a gas station.  The killer walked up from behind and shot Goforth multiple times in the back.

Shannon J. Miles, 30, was arrested on Aug. 29 and charged with capital murder in the death of Goforth.  Several Texas law enforcement officials have called the murder a “cold-blooded assassination.”

(CNSNews.com) - Hillary Clinton's comment comparing Republicans to terrorists was scripted and intentional -- "and this is what makes it so remarkable," former Arkansas Gov. Mike Huckabee told Fox News's Tucker Carlson Friday night.
"Tucker, she's talking about terrorists. I'll tell you what terrorists do. Terrorists cut people's heads off, and that's what they do in the Planned Parenthood clinics.
"If she wants to talk about protecting women, what about protecting the women who thought they were going in for a procedure to remove a mass of tissue, and in fact, a baby with a heartbeat, arms, legs, toes and eyeballs was hacked to death and the parts sold without that woman understanding that she had been exploited, she had been used, and somebody had made money off of her grief?

"If that's Hillary's definition of taking care of women, then I certainly hope I'm the one who gets an opportunity to stand on the stage and debate her about a year from now."

In one of her speeches last week, Clinton brought up "extreme views about women," a reference to those who oppose abortion and Planned Parenthood. "We expect that from some of the terrorists groups," she said. "We expect that from people who don't want to live in the modern world. But it's a little hard to take coming from Republicans who want to be the president of the United States."

Huckabee said the abortion issue transcends politics.
"Somebody ought to provide the kind of leadership to say, I don't care what the polls show. This is the mark of a barbarian society. This is not the actions of a civilized people. Civilized people don't hack other people to death and then sell the parts because there's money to be made from it.

"And that's why I find it offensive when people say, 'Well, let's see what the polls say.' Let's don't worry about what the polls say. Let's say what right and wrong."
Hillary Clinton said she hasn't seen the undercover videos shot by a pro-life group that wanted to expose Planned Parenthood's trade in aborted baby body parts.

"And I think it's pretty evident that she couldn't look at the videos and continue to stand up at the podium and make the kind of flippant remarks that she did towards Republicans and terrorism," Huckabee said..
"The fact is, if she wants to talk about terrorism, and this is classic Clinton misdirection. Let's change the subject so we don't talk about what Hillary ought to be talking about, and that's releasing top-secret information.

"But if she wants to talk about terrorists, explain the terrorists that killed four Americans the night of Benghazi on September 11th, 2012. Those were real terrorists, and they killed real Americans, and she needs to give us some better answers than she's given so far."

As CNSNews.com reported on Aug. 26, the most recent undercover video of Planned Parenthood's activities shows a biotech CEO discussing the shipment of aborted baby body parts to squeamish people in laboratories.

She explains that neural tissue is “the hardest thing in the world to ship.”
“You do it as the whole calvarium,” the CMP actor says, referring to the aborted baby’s head. “Yeah, that’s the easiest way. And we’ve actually had good success with that,” she adds.

“Make sure the eyes are closed!” the narrator of the video says to her.
“Yeah! [laughter] Tell the lab it’s coming!” she jokes, saying, “They’ll open the box, go, 'Oh God!' [laughter] So yeah, so many of the academic labs cannot fly like that, they’re not capable.”
