BIDEN SEEKS TO MAKE MARINE HOMELESS

 

The judge in our class action lawsuit against the Department of Defense (DOD) moved quickly last Thursday to protect one of our Marine plaintiffs within just two hours of our pleading. This Marine had been given 48 hours to vacate Camp Pendleton. Had we not obtained the emergency order Thursday evening, this Marine, his wife and their young children would have been homeless.

We will be back in court tomorrow, defending military members who have been unlawfully denied their federally protected RIGHT to refuse Joe Biden’s shot mandate. Plus, I have excellent news to report on our defense of health care workers fired for choosing their faith over their employer’s unlawful demands. Read on. — Mat

Zachariah* has spent years faithfully serving his country as a U.S. Marine. He loves God, family and country in that order. When the shot mandates came down, Zachariah learned that every one of the COVID shots were tested and/or developed using aborted fetal cell lines.

As a deeply pro-life and devoted Christian, Zachariah knew there was no way he would allow any abortion-tainted drug in his body. The 1993 Religious Freedom Restoration Act (RFRA) protects all military personnel and federal employees from the forced jab, but Joe Biden has ignored the law until courts block him.

Zachariah dutifully submitted his paperwork requesting religious accommodation for the shots.

Seven months went by with no word. Just silence. Then, out of nowhere and without any advance warning, Wednesday morning the U.S. Marine Corps gave Zachariah, his wife and his two young children just 48 hours to move out of their military housing and leave Camp Pendleton.

But within two hours of our emergency request last week, Judge Steven Merryday issued a temporary restraining order preventing the DOD and the Marine Corps from dismissing Zachariah from service and stopping the eviction of his young family from military housing.

In his order, Judge Merryday wrote, “The plaintiffs append First Lieutenant’s religious accommodation packet, a review of which strongly suggests that the denial of First Lieutenant’s request for a religious accommodation and the denial of his appeal are subject to the same infirmities that plagued the denial of Lieutenant Colonel 2’s appeal and USMC Captain’s appeal. Also, the denial bears an unsettling resemblance to the other appellate denials submitted.”

PLEASE PRAY! Liberty Counsel will be in court TOMORROW at 9 a.m. seeking to extend this temporary restraining order into an injunction that will protect the family throughout the course of litigation.

We continue to pursue class action relief from the unlawful federal COVID shot mandate on behalf of those who currently serve in the United States Marine Corps, as well as for all the military branches.

We are grateful the court acted quickly to provide relief for this First Lieutenant. It is unfathomable that the DOD would stoop so low as to discharge and evict a service member who has honorably served his country and the Marine Corps for merely requesting accommodation of his sincere religious beliefs.

We are hearing similar accounts from other Marines. That is why we will urge the court tomorrow to protect the entire class of Marines. Unless forced by a court, the military no longer seems interested in upholding the law or the Constitution.

Another big development against shot mandates!

Liberty Counsel recently announced the nation’s first classwide settlement for health care workers over a COVID shot mandate for more than 10.3 million dollars. Last Friday, the federal judge indicated that a hearing set for today can be canceled and an order providing initial approval of the settlement will be entered. Since this is a class settlement, there are many details to be completed. I will give you a timeline later this week.

The settlement against NorthShore University HealthSystem is on behalf of more than 500 current and former health care workers who were unlawfully fired for choosing their constitutionally and federally protected religious freedom rights over the COVID shots.
